{"id":20035,"date":"2025-09-02T11:12:03","date_gmt":"2025-09-02T09:12:03","guid":{"rendered":"https:\/\/www.maiolegal.com\/20030\/"},"modified":"2025-09-02T11:12:39","modified_gmt":"2025-09-02T09:12:39","slug":"20030","status":"publish","type":"post","link":"https:\/\/www.maiolegal.com\/en\/20030\/","title":{"rendered":"Alejandro Gil aclara las claves legales del nuevo permiso por nacimiento"},"content":{"rendered":"<p><span style=\"font-weight: 400\">La reciente reforma laboral publicada el pasado 30 de julio ha introducido modificaciones relevantes en los permisos por nacimiento, generando al mismo tiempo un notable nivel de confusi\u00f3n normativa tanto en empresas como entre trabajadores. <a href=\"https:\/\/www.maiolegal.com\/equipo\/profesional\/alejandro-gil-murillo\/\">Alejandro Gil Murillo<\/a>, socio del \u00e1rea Laboral de MAIO Legal, ha abordado esta cuesti\u00f3n en sendas intervenciones en el diario <a href=\"https:\/\/elpais.com\/economia\/2025-08-11\/la-ampliacion-del-permiso-por-nacimiento-genera-un-aluvion-de-consultas-y-reclamaciones-en-los-despachos.html\">El Pa\u00eds<\/a> y en el programa Herrera en COPE.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Seg\u00fan explica, la reforma ampl\u00eda de 16 a 19 semanas el permiso por nacimiento, manteniendo su car\u00e1cter retribuido y con dos semanas que podr\u00e1n aplicarse con car\u00e1cter retroactivo desde agosto de 2024. No obstante, esta modificaci\u00f3n no afecta al permiso parental de ocho semanas, regulado en el art\u00edculo 48 bis del Estatuto de los Trabajadores, que contin\u00faa sin ser retribuido.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Esta distinci\u00f3n, poco clara en los anuncios institucionales, ha derivado en m\u00faltiples interpretaciones err\u00f3neas, provocando una oleada de consultas jur\u00eddicas por parte de empresas preocupadas por el alcance de la retroactividad y las posibles reclamaciones de empleados.
