publica\u00e7\u00e3o Advocatus<\/a> sobre a quota introduzida em 2015 que visava garantir a imparcialidade dos agentes de execu\u00e7\u00e3o ao limitar o n\u00famero de processos que podem receber anualmente, deixando estes de estar, em princ\u00edpio, dependentes daqueles que os nomeiam.<\/p>\nSucede que, esta medida acabou por resultar numa restri\u00e7\u00e3o incompreens\u00edvel \u00e0 livre concorr\u00eancia entre estes profissionais, impedindo os Exequentes, representados pelos seus mandat\u00e1rios, de premiar os agentes de execu\u00e7\u00e3o cuja compet\u00eancia reconhecem e a quem, por isso, escolhem distribuir os processos executivos. Mais, obrigando \u00e0 recusa, pelos agentes de execu\u00e7\u00e3o, dos processos de menor valor, para que possam receber as ac\u00e7\u00f5es executivas que representem os ganhos necess\u00e1rios ao sustento da sua actividade.<\/p>\n
Praticamente uma d\u00e9cada depois, verifica-se que as restri\u00e7\u00f5es impostas n\u00e3o surtiram os pretensos efeitos, antes dificultando a colabora\u00e7\u00e3o entre os agentes de execu\u00e7\u00e3o e os Exequentes, essencial para a obten\u00e7\u00e3o de bons resultados. O caminho passar\u00e1, por isso, pela aboli\u00e7\u00e3o daquelas limita\u00e7\u00f5es, afastando-se ainda as vozes que t\u00eam surgido a favor da distribui\u00e7\u00e3o aleat\u00f3ria dos processos executivos, medida que, no nosso entender, apenas agudizar\u00e1 este problema, mais pondo em risco a sobreviv\u00eancia desta profiss\u00e3o, cuja cria\u00e7\u00e3o foi essencial para aliviar os Tribunais, at\u00e9 ent\u00e3o assoberbados com a tramita\u00e7\u00e3o destas ac\u00e7\u00f5es.<\/p>\n","protected":false},"excerpt":{"rendered":"
